1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is open to Australian, New Zealand, USA, Canadian and UK residents aged 14 years and over ("Eligible Entrants"). Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible.
3. How To Enter:
   
   

1. accept an invitation to participate in a Qualified Opinions survey during the promotional period (regardless whether he/she qualifies for the survey); OR
2. subsequently complete and submit a survey online, during the promotional period; OR
3. qualify for and subsequently participate in online research activities from time to time (as advertised and conducted on the promotional website) during the promotional period; OR
4. fully complete the "refer a friend" section of the registration form to invite a friend or colleague who qualifies as an Eligible Entrant to join the Qualified Opinions Database during the registration process ("the Referred Friend"). An email will be automatically forwarded to the friend/colleague inviting them to join. The operation of the recommendation mechanic is subject to the Spam Act 2003.

(ii) In addition to the above, should the Referred Friend subsequently complete the "refer a friend" section of the registration form to invite their friend or colleague, other than the Registered Entrant who originally referred them ("the Original Referrer"), and the friend or colleague referred by the Referred Friend qualifies as an Eligible Entrant to join the Qualified Opinions Database during the registration process, then the Original Referrer will receive an additional entry.

4. For the avoidance of doubt, limit of one (1) entry into each Major Monthly Prize Draw per Eligible Entrant by registering to join the Qualified Opinions Database or for being a current member, and bonus entries into a Major Monthly Prize Draw for each task successfully completed as outlined in condition 3(b) above.
5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
6. 6. Promotion commences 12.01am AEDST on 01/08/09. Entries close for each Major Monthly Prize Draw on the dates and times specified in the table below. Final entries close 11.59pm AEDST on 31/10/09. All draws will take place at Loyalty Marketing, Suite 11, 210 Toorak Road, South Yarra, Victoria, Australia 3141 at 4:00pm AEST/AEDST on the dates specified in the table below. Winners will be notified by mail and winners' names (of prizes valued at over $250) will be published in The Australian and on www.qualifiedopinions.com on the dates specified in the table below.

7. Major Monthly Prize Draw: The first valid entry drawn in each Major Monthly Prize Draw will win the opportunity to participate in a Game ("Participant").
8. Each Game will take place at Suite 11, 210 Toorak Road, South Yarra, Victoria, Australia 3141 at 3pm AEDST on the following dates: Game 1: 14/09/09; Game 2: 14/10/09; Game 3: 18/11/09.  The Participant will be required to participate in the Game via telephone.  The Participant may appoint a proxy over 18 years of age to play the Game on the Participant's behalf provided that the Participant gives the Promoter written notice to that effect before the start of the Game. In the event that the Promoter has not been able to contact the drawn Participant before the commencement of the Game, a representative of the Promoter will play the Game on the drawn Participant's behalf.
9. There will be 250 envelopes numbered 1 to 250 laid out on display at the commencement of the Game.  One (1) envelope will contain the 'Major Prize' message and the remaining 249 envelopes will contain the 'Consolation Prize' message. The Participant will be required to choose only one (1) of the envelopes on display without handling, touching, or interfering in anyway with any of the envelopes on display other than the envelope chosen by them. If the Participant breaches this condition he/she will be disqualified. If the envelope selected by the Participant contains the 'Major Prize' message, the Participant will win cash to the value of AUD$50,000. If the Participant has selected an envelope containing a 'Consolation Prize' message, the Participant will receive AUD$500 cash.
10. If the Participant is a representative of the Promoter or a proxy, the prize will be awarded to the original Participant drawn.  All prize messages contained in the envelopes not selected by the Participant will not be given away.
11. The odds of winning the Major Prize in a Game, once drawn as a Participant, are 1:250.
12. Total potential prize value for the entire promotion is up to AUD$150,000
13. Unless expressly stated within these Terms and Conditions regarding all prizes, all other expenses become the responsibility of the winner.
14. All prize values are in AUD$.
15. For any cash prize winner(s) residing in Australia, their cash prize will be awarded their prize in the form of a cheque OR directly deposited into the winner's bank account (depending on the options selected by the winner at the time of registration).
16. For any cash prize winner(s) residing outside Australia, their cash prize will be converted to the relevant currency for their country of residence based on the conversion market rate that is applicable on the day their payment is processed, and will be awarded through the on-line PayPal system to the winner's personal PayPal account (full details at www.paypal.com). It is a condition of participating in the promotion that residents of New Zealand, USA, Canada and UK agree to receive any cash prize payments through the on-line PayPal system in accordance with PayPal terms and conditions. As PayPal account types other than personal accounts may incur fees, only personal accounts will be eligible to receive payment.
17. If the winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian.
18. Promoter's decision is final and no correspondence will be entered into.
19. In the event that any original Participant drawn has not come forward to claim his/her prize by 07/05/10 the Promoter may conduct a further draw on this date at 3pm AEST at the same place as the original draw, to distribute any prize selected in the Game by the Promoter in accordance with clause 8, subject however to any regulatory authority. In the event of any winners, their name will be published in The Australian on 14/05/10.
20.  If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Any costs associated with accessing the promotional website is the Eligible Entrant's responsibility and is dependent on the Internet service provider used.  Any contact details entered incorrectly on the website shall be deemed invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
22.  Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) a prize.
23.  The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
24. Eligible Entrants consent to the Promoter using the Eligible Entrant's name, likeness, image and/or voice in the event they are a winner (incl. photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
25. The Promoter reserves the right to request the Participant to provide proof identity prior to the Game.  Identification considered suitable for verification is at the discretion of the Promoter.
26. The laws of Australia apply to this promotion to the exclusion of any other law.  Entrants submit to the exclusive jurisdiction of the courts of Australia.
27. Each Eligible Entrant hereby warrants and confirms that his/her participation in this promotion is not illegal or prohibited according to the laws of his/her country and any other applicable laws, and that he/she has obtained all necessary approvals and consents to enable him/her to participate in the promotion. If an Eligible Entrant's participation in the promotion would contravene the applicable laws in his/her country of residence, he/she is not permitted to participate in the promotion and his/her entry will be deemed invalid.

3. The maximum number of different, single syndicated Lotto games is 10. The maximum number of syndicate members is 250.

5. A First Division win requires that that the six Saturday Lotto Numbers issued on registration in the Qualified Opinion Survey match the 6 First Division Numbers in the last Saturday Lotto of the month in which the participant registered.

7. Each holder of a winning Qualified Opinions Pty Ltd Syndicate Numbers for Lotto will then win an equal share of whatever First and/or Second Division prizes are won by that Syndicate.
8. Only claims based on original and legally obtained Qualified Opinions Pty Ltd Syndicate Numbers for Lotto published in www.qualifiedopinions.com will be accepted. Syndicate Numbers for Lotto will be declared void if they fail to pass the promoter's validation test.
9. Any First or Second Division prize money not validly claimed by 6pm Friday 7 days from last Saturday Lotto of the month in which the participant registered, will be divided equally between those members of the Qualified Opinions Pty Ltd Syndicate to whom the prize relates and who have claimed by that specified time.
10. Only the person named on the Qualified Opinions Pty Ltd Syndicate Numbers for Lotto claim form submitted for verification will be recognised as the owner of any interest in the Qualified Opinions Pty Ltd Syndicate.
11. Please allow 10 weeks for receipt of prize money.
12. Qualified Opinions Pty Ltd will publish the winning Lotto numbers in www.qualifiedopinions.com.
13. Participation in the Qualified Opinions Pty Ltd Syndicate Numbers for Lotto game implies acceptance of all terms and conditions as well as the relevant terms and conditions governing the conduct of Lotto.
14. If a winner is under the age of 18 years, the prize will be awarded to the winner's parent or guardian.
